Terms of Service

These Terms of Service ("Terms") govern your access to and use of CrowdWatch's website, applications, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Description of the Service

CrowdWatch is a content discovery, scheduling, and notification platform that helps users find, follow, and receive information about live and scheduled content from third-party platforms and creators. CrowdWatch does not host, stream, upload, or store third-party video or audio content unless explicitly stated.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian.

3. Accounts

To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your credentials and all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

4. Free and Paid Plans

CrowdWatch may offer free features and paid subscription plans. If you purchase a paid plan, you agree to:

  • Pay all applicable fees and taxes;
  • Provide accurate and current billing information; and
  • Authorize CrowdWatch and/or our payment processor to charge your payment method.

Unless required by law or explicitly stated at purchase, fees are non-refundable.

We may change prices or plan features with reasonable advance notice (typically 30 days for existing subscribers).

5. Creator and Business Accounts

If you register as a Creator or Business user, you represent and warrant that:

  • You have the right to promote and share information about the content you add to CrowdWatch;
  • You will provide accurate scheduling and content information to users;
  • You will comply with all applicable laws and platform policies;
  • You will not use CrowdWatch to distribute spam, malware, or misleading information.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, or abusive purposes;
  • Attempt to gain unauthorized access to systems or data;
  • Scrape, crawl, reverse engineer, or overload the Service;
  • Misrepresent your identity or impersonate others;
  • Interfere with the security or operation of the Service;
  • Upload or transmit viruses, malware, or other malicious code; or
  • Violate any applicable laws or regulations.

We reserve the right to remove content or suspend accounts that violate these Terms or create risk for CrowdWatch or our users.

7. Third-Party Content and Services

The Service may display, embed, or link to third-party content and services (including but not limited to YouTube, Twitch, Facebook, Instagram, LinkedIn, and Patreon). CrowdWatch does not control and is not responsible for third-party content, availability, accuracy, or policies. Your use of third-party services is governed by their terms.

8. Intellectual Property

All CrowdWatch trademarks, branding, software, design, and original content are owned by CrowdWatch or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or exploit any portion of the Service without permission.

9. User Content

If you submit content to the Service (for example, profile details, preferences, text, images, or metadata), you grant CrowdWatch a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute that content solely to operate, improve, and promote the Service.

You represent and warrant that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights or applicable laws.

10. Content Moderation

CrowdWatch reserves the right to review, moderate, remove, or restrict access to any content or user accounts that violate these Terms, our community standards, or applicable laws. We are not obligated to monitor all content but may do so at our discretion.

11. DMCA and Copyright

CrowdWatch respects intellectual property rights. If you believe content on the Service infringes your copyright, please see our DMCA / Copyright Policy for information on how to file a notice.

12. Termination

We may suspend or terminate access to the Service at any time if you violate these Terms, create risk for the platform, engage in fraudulent activity, or misuse the Service. You may stop using the Service at any time by closing your account.

Upon termination, your right to use the Service will immediately cease, but provisions that by their nature should survive (including ownership, warranty disclaimers, and limitations of liability) will remain in effect.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We make no warranties regarding uptime, accuracy, reliability, or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

To the fullest extent permitted by law, CrowdWatch and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the previous 12 months.

15. Indemnification

You agree to indemnify, defend, and hold harmless CrowdWatch and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from your misuse of the Service, violation of these Terms, or infringement of any third-party rights.

16. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property disputes. You waive any right to participate in class-action lawsuits or class-wide arbitration.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date or by sending you notice through the Service or email. Continued use of the Service after updates constitutes acceptance of the revised Terms.

18. General Provisions

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms at any time.

19. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any legal action must be brought in the state or federal courts located in Fulton County, Georgia.
