DMCA / Copyright Policy
CrowdWatch respects the intellectual property rights of others and expects users, creators, and partners to do the same. This policy explains how we respond to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
1. Reporting Copyright Infringement (DMCA Notice)
If you believe that your copyrighted work has been infringed and is accessible via the Service, you may submit a written DMCA notice to our designated Copyright Agent. Your notice must include the following information as required by 17 U.S.C. § 512(c)(3):
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work: Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list
- Identification of the infringing material: Identification of the material on CrowdWatch that you claim is infringing, with enough detail for us to locate it. Please include:
- The specific CrowdWatch page URL
- The third-party content link or embed, if applicable (e.g., YouTube video URL, Twitch stream link)
- Screenshots or other supporting evidence, if helpful
- Your contact information: Your full name, mailing address, telephone number, and email address
- Good-faith statement: A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
2. Submitting Your DMCA Notice
Send your complete DMCA notice to our designated Copyright Agent:
Email: dmca@thecrowdwatch.com
Subject Line: DMCA Takedown Request
Mailing Address: [To be updated after incorporation]
3. Our Response to Valid DMCA Notices
Upon receiving a valid DMCA notice, CrowdWatch will:
- Promptly investigate the reported material and verify the notice meets DMCA requirements
- Remove or disable access to the allegedly infringing content, if appropriate
- Notify the user who posted or linked to the content, if applicable
- Document the complaint in accordance with DMCA requirements (17 U.S.C. § 512(c)(3))
Note: Because CrowdWatch primarily aggregates and links to third-party content hosted on other platforms (YouTube, Twitch, etc.), we may also refer you to file a DMCA notice directly with the hosting platform if the content resides there.
4. Counter-Notification
If you believe that material you posted or linked to was removed or disabled by mistake or misidentification, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed or disabled, and the location where it appeared before removal
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of Georgia if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person
Send your counter-notification to: dmca@thecrowdwatch.com
5. Response to Counter-Notifications
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a lawsuit seeking a court order within 10-14 business days, we may restore the removed content.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, CrowdWatch has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
7. Third-Party Content
CrowdWatch aggregates and displays scheduling information and links to content hosted on third-party platforms such as YouTube, Twitch, Facebook, Instagram, and others. We do not control these platforms or the content hosted on them. If you believe content on a third-party platform infringes your copyright:
- File directly with the platform: Contact the hosting platform's DMCA agent directly (e.g., YouTube's copyright team, Twitch's legal department)
- Also notify CrowdWatch: If the infringing content is linked or displayed on CrowdWatch, you may also file a DMCA notice with us, and we will evaluate whether to remove the link or reference
8. Copyright Ownership and Licensing
All CrowdWatch original content, including our website design, software, logos, branding, and documentation, is owned by CrowdWatch or our licensors and protected by U.S. and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without permission.
9. Fair Use
CrowdWatch recognizes that certain uses of copyrighted material may constitute fair use under U.S. copyright law (17 U.S.C. § 107). We evaluate DMCA notices with consideration for fair use principles, but we are not in a position to provide legal advice regarding fair use. If you believe your use qualifies as fair use, you may include that explanation in your counter-notification.
10. Modifications to This Policy
We may update this DMCA / Copyright Policy from time to time. Changes will be posted with a new "Last Updated" date. Continued use of the Service after updates constitutes acceptance of the revised policy.
